Parties
These Terms of Use apply to the subscription taken out by you with Safe Circle ApS.
What SafeCircle Is
SafeCircle is a digital safety app that, in unsafe situations, helps users activate assistance, share their location, and document incidents via audio and video. SafeCircle is a supplement to public emergency services and cannot replace them.
SafeCircle Is Not an Emergency Service
In case of immediate danger to life, health or safety, always contact 112. SafeCircle cannot guarantee response times from helpers, network coverage, app availability, or that incidents will be prevented.
Geographic Coverage and MitID Requirement
SafeCircle requires Danish MitID for identity verification at sign-up. The app is currently available exclusively to persons with Danish MitID and is designed for use in Denmark. The SafeCircle helper network is likewise limited to Denmark.
Age Requirements
You must be at least 18 years of age to take out a subscription. Persons who are not yet 18 may take out a subscription if consent is given by their parent(s) or legal guardian.
Device Permissions
SafeCircle requires access to the following features on your phone to function correctly: location (GPS) for sharing your position during an alarm, microphone and camera for audio and video recording, and push notifications for sending and receiving alarms. If you decline one or more of these permissions, parts of SafeCircle's functionality will not be available. SafeCircle only uses the microphone and camera while an alarm is active. You are responsible for the security of your login credentials and all activity on your account.
Responsible Use of the Alarm Function
The alarm function may only be activated in situations where you feel unsafe or need assistance and documentation. Misuse of the alarm function is not permitted. Misuse will, as a minimum, result in immediate account termination.
Accidental Alarm Activation
If you activate an alarm by mistake, you can cancel the alarm directly in the app. Your emergency contacts and any nearby helpers will receive a notification that the alarm has been cancelled. SafeCircle recommends that you immediately contact your emergency contacts to confirm that no assistance is needed. SafeCircle cannot be held liable for reactions, costs or actions taken by emergency contacts or helpers as a result of an accidentally activated alarm.
Recording Function
SafeCircle may record audio and video during an active alarm. Recordings are stored on an encrypted server and are protected by Danish law and GDPR. Recordings belong to the user. Law enforcement may obtain recordings in accordance with applicable law. Safe Circle ApS only accesses recordings in connection with such a disclosure.
Emergency Contacts and Helpers
You are responsible for obtaining consent from the persons you add as emergency contacts. SafeCircle bears no liability if emergency contacts fail to respond to an alarm.
Helper Status and Responsibility
SafeCircle helpers are voluntary private individuals who have signed up to offer assistance to other users in their vicinity. Helpers are not employees, contractors, agents or representatives of Safe Circle ApS.
Each helper independently decides whether to respond to an alarm and, if so, how. SafeCircle has no influence over whether helpers are present in the vicinity at a relevant time, or how a helper may provide concrete assistance. SafeCircle is not liable for actions or omissions by helpers.

Subscription and Payment
Prices: A personal subscription costs 9 DKK/month. If the subscription is taken out for a 1-year period, the price is 99 DKK/year. A family subscription (up to 8 licences in the same household) costs 69 DKK/month. If the family subscription is taken out for a 1-year period, the price is 689 DKK/year. All prices include Danish VAT.
Payment: Payment is processed through the Apple App Store or Google Play Store depending on the platform you use. Apple Inc. and Google LLC are the legal seller responsible for the payment transaction. SafeCircle does not receive or store your card details.
Automatic renewal: Subscriptions renew automatically for the same period and at the price applicable at that time, unless you cancel the subscription at least 24 hours before the end of the current period.
Cancellation: You may cancel your subscription at any time via your App Store or Google Play settings. Upon cancellation you retain access for the remainder of the paid period. Payments already made are non-refundable for the current period, unless otherwise required by consumer law.
Cancelling an annual subscription (12 months): If you have chosen to pay for 12 months at a time (99 DKK/year or 689 DKK/year), you are not locked in for the full period. Under section 28 of the Danish Consumer Contracts Act (forbrugeraftaleloven), you may cancel your subscription with 1 month's notice to the end of a month, once 5 months have passed since you signed up โ even though you prepaid for 12 months. Cancelling via the App Store or Google Play automatically stops future renewal, but does not by itself refund an already prepaid period. To exercise your right of cancellation under section 28 and receive a pro-rata refund of a prepaid year from the date of cancellation, please contact us at support@safecircle.dk and we will process your request.
Right of withdrawal: As a consumer you have a 14-day right of withdrawal from the date of purchase under the Danish Consumer Contracts Act (forbrugeraftaleloven) ยงยง 18โ24. The right of withdrawal lapses if you have expressly agreed that access to the app begins before the withdrawal period expires and you have been informed that the right of withdrawal is thereby lost. You accept this by beginning to use SafeCircle after taking out the subscription. To exercise your right of withdrawal, you must contact us at support@safecircle.dk before the 14 days expire.
Price changes: SafeCircle will give at least 30 days' prior notice of price changes. If you do not cancel your subscription after receiving notice of a price change, you accept the new price.
Cancellation of a Family Subscription
A family subscription (up to 8 licences) can only be cancelled by the account holder who has taken out and paid for the subscription ("primary user"), via their App Store or Google Play account. Family members cannot cancel the family subscription themselves. At the end of the notice period, all linked family members will lose access to SafeCircle. All users' accounts and data are then deleted in accordance with our Privacy Policy. SafeCircle recommends that the primary user notifies family members before cancelling.
Force Majeure
SafeCircle is not liable to the customer to the extent that the cause of a failure, and any resulting loss, is due to circumstances beyond SafeCircle's control which SafeCircle could not reasonably have anticipated at the time the subscription was entered into and could not reasonably have avoided or overcome, including but not limited to unforeseeable failures, delayed or missing deliveries, strikes, lockouts, lack of transport facilities, restrictions imposed by public authorities, and similar events.
Limitation of Liability
SafeCircle bears no liability for any consequence of a lack of network connectivity, technical failures, response times of helpers or others, or incidents that could not be prevented. If SafeCircle is held liable under mandatory law, SafeCircle's total liability shall not exceed an amount equivalent to a personal subscription for the 3 months preceding the event giving rise to liability.
Changes to These Terms
SafeCircle reserves the right to amend these Terms. Material changes will be notified at least 30 days in advance by email. Continued use of the app following the effective date of any change constitutes acceptance of the updated Terms.
Transfer
SafeCircle is entitled, with releasing effect, to transfer SafeCircle's rights and obligations under the subscription, in whole or in part, to a third party, provided the transfer takes place on unchanged terms for the customer.
Governing Law and Jurisdiction
These Terms are governed by Danish law. Disputes shall be sought resolved amicably. If no agreement can be reached, the venue shall be the District Court of Roskilde.
